The United States antitrust laws are powerful but simple statutes. The brief wording of these statutes, however, has been the subject of numerous court decisions over decades. Thus, a substantial body of case law exists applying these laws in various contexts. Great care needs to be exercised to ensure compliance with these statutes, particularly the prohibitions against cartels. Price fixing cartel cases pose the risk of severe antitrust criminal fines, incarceration for senior executives, and the even larger potential monetary exposure resulting from private civil treble damage class actions.
