The California Pay Equity Act, and AB 168 prohibiting the reporting of salary history on employment applications, are among the latest forms of compensation legislation affecting employer work practices. These statutes, along with minimum wage statues, have greatly heightened applicant, employee, and employer awareness of the need for employers to have a defensible basis for determining compensation rates and avoiding discrimination on the basis of gender and other protected classes.
