In series extraordinary recent prosecutions, the Department of Justice has applied criminal antitrust laws to labor markets.
The DOJ has aggressively investigated and charged companies and individuals with alleged wage fixing and “no poaching” arrangements. Civil litigation in this area has also ramped up.
These prosecutions have faced significant setbacks but still highlight real risks lurking in the labor markets.
This presentation will review the civil and criminal cases and then turn to the nuts and bolts faced by in-house lawyers (and employees) regularly when navigating non-solicits, non-competes and other critical aspects of employment law.
