Over the last few years, regulators and industry initiatives have increasingly focused on PFAS in the environment and certain products, including food packaging, cookware, textiles, and cosmetics. Following these regulations and initiatives, there has been much publicity about PFAS in consumer products, such as the March 2022 article by Consumer Reports entitled “Dangerous PFAS Chemicals Are in Your Food Packaging”. This, in turn, has spawned consumer class action litigation targeting products identified in the news articles or subject to state PFAS regulations. So far, this litigation has used a false advertising approach (e.g., “greenwashing”, failure to disclose the presence of PFAS, products containing PFAS are worth less than what consumers paid for them, etc.).
This presentation will discuss the shifting landscape of this litigation, including the kinds of marketing claims that may trigger the litigation, the patchwork of state regulations that support both the litigation and potential resolution of these actions, the difficulties with product testing, and key takeaways for companies.
