The intersection of IP and employment law within the videogame business can be challenging. Taking a wrong turn may result in not obtaining ownership of the IP that is the key to your business, or in class action lawyers descending on your business like zombies. We address why you need to carefully distinguish between employees and contractors, and how to ensure that you do so in a way that protects your business. Along the way, we’ll battle misclassification, fight the dreaded statutory employee, and help you learn to wield the work for hire agreement and the employee invention assignment clause.
