Kate Eberhardt is special counsel in the Real Estate, Energy, Land Use & Environmental Practice Group in the firm's Dallas office.
Areas of Practice
Kate has a broad based real estate transactional practice with experience in real property purchase and sale, leasing, financing, development, construction, entity formation and structuring. She represents owners, developers, investors, borrowers, and lenders on a multitude of matters, involving a variety of asset types, including mixed-use development, office, retail, hotel, and multifamily. She also represents lending institutions and borrowers in real estate secured financings for purchase of real property and construction of improvements on real property. Kate is well versed in documentation and negotiation of ground leases (including sale-leasebacks), co-lending and loan participations, and has counseled clients on loan workouts and debt restructurings.
Experience

- Represented a national developer in connection with a construction loan to finance the development and construction of a mixed-use development, consisting of 332 multifamily units and approximately 6,333 square feet of retail space, in Kirkland, Washington.
- Represented a publicly traded developer in connection with multiple loans to finance the development and construction of a 200+ acre mixed-use property, including retail, office, hospitality and entertainment development.
- Represented lender providing warehouse financing to various originators.
- Represented a political subdivision in multiple railroad acquisitions and conducted the related risk analysis.
- Drafted and negotiated documentation in connection with secured and unsecured lending transactions.
- The acquisition and financing of multiple multifamily portfolios.
- The acquisition and financing of multiple office portfolios.
