EPA Reversal on Pebble Mine Pollution Limits is Reviewable
In a ruling published on June 17, the Ninth Circuit Court of Appeals ruled that Sheppard Mullin client Trout Unlimited’s lawsuit challenging the Environmental Protection Agency’s 2019 decision to withdraw proposed protections for the Bristol Bay watershed could move forward. Bloomberg Law quoted Sheppard Mullin partner Paul Werner, "The court’s ruling is an important step in securing long-term protections for the Bristol Bay and its unique watershed. We are pleased the Ninth Circuit recognized EPA does not have unfettered discretion to allow mining in the bay."
