Sheppard Mullin NY Wins $130 Million Verdict

Partner James McGuire and associates Mark Berube, Elizabeth Rotenberg-Schwartz, Carl LeSueur, Vincent Filardo, all of the firm's New York office, secured a net verdict of $129.9 million from a Maryland federal jury on behalf of Final Analysis Communications Services, Inc. ("Final Analysis") on September 6, 2005. The verdict was rendered against General Dynamics Corp. and its subsidiary, General Dynamics Information Systems, Inc. (collectively, "General Dynamics"). The Firm was engaged approximately four months prior to the verdict to act as trial counsel. Final Analysis had been represented during the earlier phases of the litigation by Kelley Drye & Warren LLP.
The breach of contract action centered on General Dynamics' failure to fulfill its obligations, reflected in a series of agreements, help Final Analysis construct and finance a $400 million satellite system designed to provide data transmission services, including asset tracking, monitoring, paging and text messaging. General Dynamics had committed to act as a "strategic partner" to Final Analysis that would both design and construct significant portions of the satellite system, as well provide substantial equity contributions to the start-up satellite company.
