Court Issues Favorable Decision for Sheppard Mullin Client, DVI Business Credit
Sheppard, Mullin, Richter & Hampton is proud to announce that after a four-week bench trial, its trial team, headed by Finley Taylor and Matthew Erwin, obtained a decision on behalf of client DVI Business Credit Corporation in MedCap Credit Co., LLC v. DVI Business Credit, Inc., et al. Judge James P. Gray of the Orange County Superior Court issued an award of $18 million in breach of contract damages in favor of DVI Business Credit, a unit of NYSE-listed DVI, Inc. The Court also issued $1.6 million for fraud damages, and an additional $750,000 in punitive damages, against Dale Papworth, MedCap's President.
Mr. Taylor, lead trial attorney, commented, "MedCap filed this lawsuit, claiming that MedCap did not owe DVI anything, and that DVI had breached the contract. We are obviously pleased that DVI's position has been vindicated completely."
