Sheppard Mullin Obtains Fifth Circuit Win Dismissing Putative Class Action Against AIS Healthcare
The Fifth Circuit Court of Appeals affirmed the District Court for the Eastern District of Louisiana’s dismissal of a putative class action against Sheppard Mullin client AIS Healthcare, a leading provider of targeted drug delivery and specialized home infusion care across the country.
Background on the Case
For years, the plaintiff received custom medication provided by AIS Healthcare through an implanted pump to treat her chronic pain. But when she discovered that AIS billed certain charges to her insurer, she sued on behalf of herself and a putative class alleging that AIS did not provide services warranting the charges.
AIS removed the suit to federal court and moved to dismiss, which the district court promptly granted. The plaintiff then appealed that ruling, and on September 30, the Court of Appeals for the Firth Circuit affirmed the district Court’s judgment, holding the plaintiff could not pursue claims based on charges paid by her insurer.
